this article is pretty crappy, the one over at xbox-scene has more info. how they approach this suit makes a world of differenceif they go for the "your console was banned, and you didn't receive a pro-rated refund" route, they are screwed. they have no case as the xbox live account is still active and working. it was only a non compliant system that had its access revoked.they MAY have a case if they focus on how microsoft disabled harddrive installs on the recently banned systems by deleting the digital certificate used to validate the install from the NAND flash. (the data is actually deleted, and if you have a valid backup prior to being banned, you can restore it and fix the problem. microsoft IS deleting/modifying data from your system). going after the data modification angle, they might be able to get some results.
